You have a right to receive a copy of this Notice (in paper or electronic form) and to discuss it with Anchor Addiction and Wellness Center staff.
OUR LEGAL DUTIES
Anchor Addiction and Wellness Center (“Anchor”) is required by federal law, including the Health Insurance Portability and Accountability Act (HIPAA) and 42 CFR Part 2, to maintain the privacy and security of your health information and to provide you with this Notice explaining our legal duties and privacy practices.
Federal law protects the confidentiality of substance use disorder (“SUD”) patient records. Anchor must comply with these laws and provide you with a written summary of these confidentiality protections.
Anchor is required to:
- Maintain the privacy of your protected health information (PHI) and Part 2 records
- Provide you with this Notice of Privacy Practices
- Notify you following a breach of unsecured PHI or Part 2 records when required by law
- Follow the terms of this Notice currently in effect
We reserve the right to change our privacy practices and this Notice. Any revised Notice will apply to all information we maintain.
HOW WE MAY USE AND DISCLOSE YOUR INFORMATION
Anchor will limit uses and disclosures of your information to the minimum necessary to accomplish the intended purpose unless otherwise required by law. Federal law allows Anchor to use and disclose your health information for specific purpose with your written consent when required under 42 CFR Part 2. These include:
Treatment
We may use and disclose your health information to provide, coordinate, or manage your care, including sharing information with physicians, nurses, pharmacists, counselors, or other treating providers involved in your treatment.
Payment
We may use and disclose your information to obtain payment for services provided to you, including billing insurance companies or other third-party payers.
Health Care Operations
We may use and disclose your information for operations necessary to run our program, such as:
- Quality improvement
- Licensing and accreditation
- Staff training
- Compliance and auditing
With Your Written Consent
Anchor may disclose your substance use disorder records to individuals or organizations only with your written consent, unless otherwise permitted or required by law. Disclosures made with your consent will include an explanation of the scope of your consent or a copy of your consent as required by federal regulations. You may revoke your consent at any time, except to the extent action has already been taken. Anchor does not use substance use disorder treatment records for fundraising without your written authorization.
USES AND DISCLOSURES WITHOUT YOUR CONSENT
Federal law strictly limits when your information may be disclosed without your consent. Examples include:
Medical Emergencies: Information may be disclosed to medical personnel to treat a medical emergency.
Program Personnel and Administrative Control: Information may be shared among Anchor staff who need the information to provide treatment, payment, or health care operations.
Audits, Evaluation, and Oversight: Federal, state, or local authorities may review records for audit or program evaluation purposes.
Court Orders: Information may be disclosed when authorized by a valid court order meeting federal confidentiality requirements.
Part 2 records may not be used or disclosed in civil, criminal, administrative, or legislative proceedings against you without your specific written consent or a court order.
DISCLOSURES NOT PROTECTED BY 42 CFR PART 2
The following information is not protected by Part 2 confidentiality laws:
- Information related to a crime committed on Anchor premises or against Anchor personnel
- Reports of suspected child abuse or neglect made to appropriate authorities
Federal law specifically allows disclosure of this information.
LIMITED ACKNOWLEDGEMENT OF YOUR PRESENCE
Anchor generally may not acknowledge that you are receiving services here or disclose information identifying you as a patient without your written consent, except in limited circumstances permitted by law.
YOUR RIGHTS REGARDING YOUR INFORMATION
You have the right to:
Access and Obtain Copies: You may inspect and obtain copies of your health records.
Request Corrections: You may request corrections to inaccurate or incomplete records.
Request Restrictions: You may request limits on certain uses and disclosures of your information.
Request Confidential Communications: You may request communications by alternative means or locations.
Receive an Accounting of Disclosures: You may request a list of certain disclosures made without your consent.
Receive a Copy of This Notice: You may receive a paper or electronic copy of this Notice at any time.
REDISCLOSURE PROHIBITED
Federal law prohibits unauthorized use or disclosure of your substance use disorder records. Recipients of your information may not redisclose it unless permitted by law or with your written consent.
ANTI-DISCRIMINATION PROTECTIONS
Federal law prohibits discrimination against you based on your substance use disorder treatment records. Part 2 records may not be used to discriminate against you in employment, housing, health care access, courts, or government services.
VIOLATIONS AND COMPLAINTS
Violation of federal confidentiality law is a crime. If you believe your privacy rights have been violated, you may file a complaint with Anchor Addiction and Wellness Center or with the U.S. Department of Health and Human Services. You will not be retaliated against for filing a complaint. You must file complaints with HHS within 180 days of when you knew or should have known of the violation.
